Malaky respects the privacy of its users and is committed to handling personal information responsibly and transparently.
This Privacy Policy explains the categories of information Malaky may collect, how such information may be used, and how it may be handled and protected.
1. Information We May Collect
When users register for or use Malaky, we may collect information they provide directly, including:
- name
- email address
- contact information
- account information
- profile information
- designer or brand information
- country or city information where requested
- website or social media links provided by the user
- designs, images, files, and content uploaded to the platform
- documents provided for account or rights verification and
- communications and requests sent to Malaky.
Depending on the technologies used by the platform, Malaky may also collect technical information such as browser type, device information, IP address, and platform usage data.
2. Information Collected Through Intellectual Property Reports
If a person submits an Intellectual Property Infringement Report, Malaky may collect information provided through the reporting form, including:
- name
- email address or contact information
- the reporting person's capacity or relationship to the rights holder
- information concerning the rights holder
- details about the allegedly infringing design or content
- ownership evidence or supporting documentation and
- additional information or files provided in support of the report.
Reports may be submitted directly from the same page of the design concerned using the reporting option available on that design page.
This information may be used to investigate the report, communicate with relevant parties, verify rights, and determine an appropriate course of action.
3. How We Use Information
Malaky may use personal information for purposes including:
- creating and managing user accounts
- reviewing membership applications
- approving or rejecting accounts
- reviewing designs and other content
- operating the Malaky platform
- improving and developing platform services
- communicating with users
- providing support
- preventing fraud and platform misuse
- investigating intellectual property infringement reports
- verifying intellectual property rights
- complying with legal and regulatory obligations and
- promoting Malaky and participating designers in accordance with the permissions granted to the platform.
4. User Responsibility for Submitted Information
Users are responsible for ensuring that information submitted to Malaky is accurate and lawful.
Users also represent that they are legally entitled to submit any information, designs, documents, images, or other files provided to the platform.
Malaky is not responsible for users submitting information or content without the required rights, permissions, or authorizations.
5. Designs and Intellectual Property
Original intellectual property rights in designs published through Malaky remain with their lawful owners.
Users represent that they own the designs they submit or have appropriate legal authorization to publish them.
Where a person believes that content infringes their intellectual property rights, they may submit a report directly from the same page of the design concerned using the reporting option available on that design page.
Malaky may review information and documentation submitted by the relevant parties before making a decision regarding the disputed content.
6. Use of Designs for Promotion
When a user publishes a design on Malaky, the user permits the platform to use the design or related imagery for purposes associated with showcasing and promoting Malaky, the designer, or the relevant brand.
This may include publication or republication through Malaky's official social media accounts and use in Malaky promotional or marketing materials.
Ownership of the original design remains with its lawful owner.
7. Account and Content Review
Malaky may review account information, designs, and other submitted content to determine whether they meet platform requirements.
Review of account applications and certain content may normally take between one and three days.
7.1. AI-Generated Designs
When a design has been generated wholly or partly using artificial intelligence tools, Malaky requires the user to disclose this by selecting the AI-generated design option when submitting the design.
Malaky may retain and use this information for purposes such as classifying the design, displaying it to users, reviewing it, managing content, and applying platform standards relating to AI-generated designs.
If a design is AI-generated and the user does not disclose this through the designated option, the design may be rejected during review.
Malaky does not encourage relying on AI-generated designs as a substitute for designs that have been genuinely created or physically executed. AI-generated designs may receive less visibility on the platform than designs that have been actually executed. Their review and approval may also take longer than the usual review period, depending on the nature of the design and the review requirements.
8. Sharing Personal Information
Malaky does not sell users' personal information.
Information may be shared where reasonably necessary with:
- technology service providers
- hosting providers
- email service providers
- infrastructure providers supporting the platform
- governmental, regulatory, or legal authorities where required by law
- professional advisers assisting Malaky in protecting its rights and
- parties involved in an intellectual property dispute where disclosure of limited information is reasonably necessary to investigate the report or protect legal rights.
Malaky seeks to limit disclosures to information reasonably necessary for the relevant purpose.
9. Information Security
Malaky uses reasonable technical and organizational safeguards designed to protect personal information against:
- unauthorized access
- unauthorized use
- alteration
- loss and
- unauthorized disclosure.
However, no online system or electronic storage method can be guaranteed to be completely secure.
10. Data Retention
Malaky may retain personal information for as long as reasonably necessary to provide the platform's services, administer accounts, and fulfill the purposes described in this Privacy Policy.
Certain information may be retained for longer periods where required for legal, regulatory, rights-protection, dispute-resolution, or intellectual property enforcement purposes.
11. Account Deletion and Data
Designers and account holders may request deletion of their Malaky account at any time by contacting us by email and submitting a clear account deletion request.

Malaky may request additional information reasonably necessary to verify the identity of the account holder before processing the deletion request, in order to protect accounts and prevent unauthorized deletion requests.
Following account closure, Malaky may delete, anonymize, or restrict access to personal information where there is no longer a legitimate or legal reason to retain it.
Certain records may continue to be retained where necessary to comply with legal or regulatory obligations, protect Malaky's rights, or manage prior disputes or infringement reports.
12. Your Privacy Rights
Subject to applicable laws, users may have the right to request:
- information about personal data held by Malaky
- information regarding how their personal data is used
- correction of inaccurate information
- completion of incomplete information
- updating of personal information and
- deletion of certain personal information where legally permitted.
Malaky may need to verify the identity of the requester before processing certain privacy requests.
13. Third-Party Links
Malaky may contain links to third-party websites, platforms, or services.
Malaky is not responsible for the privacy practices of those external services.
Users are encouraged to review the relevant privacy policies before providing personal information to third-party services.
14. Changes to This Privacy Policy
Malaky may update this Privacy Policy as the platform develops, its data practices change, or where otherwise necessary.
The latest version will be published on the platform together with the date of the most recent update.
