1. About Malaky

Malaky is a platform dedicated to women's fashion and design, providing designers and fashion brands with a professional space to showcase and promote their work.

Malaky is intended exclusively for women's fashion.

Designs or products intended for men or children may not be published on the platform.

Malaky reserves the right to remove content that does not fall within the intended scope of the platform.

2. Registration and Account Approval

Designers and fashion brands may apply to join Malaky by submitting the required information.

Applicants are responsible for ensuring that all information submitted is accurate, truthful, and current.

Malaky may review all registration applications and approve or reject them according to the platform's standards and policies.

Account applications will normally be reviewed within one to three days of submission.

Submitting an application does not guarantee acceptance.

3. Design and Content Review

Designs and other content submitted to Malaky may be reviewed before or after publication.

Approval or rejection of newly submitted content may normally take between one and three days.

Malaky reserves the right to approve, reject, hide, or remove content that does not meet its requirements or policies.

3.1. AI-Generated Designs

When uploading any design that was generated wholly or partly using artificial intelligence tools, the user must clearly disclose this by selecting the AI-generated design option when submitting the design.

If a design is AI-generated and the user does not disclose this through the designated option, the design may be rejected during review, and the user remains responsible for the accuracy of the information submitted to the platform.

Malaky does not encourage relying on AI-generated designs as a substitute for designs that have been genuinely created or physically executed. AI-generated designs may receive less visibility on the platform than designs that have been actually executed. Their review and approval may also take longer than the usual review period, depending on the nature of the design and the review requirements.

4. User Responsibility for Information

Users are solely responsible for all information, data, designs, images, and other content they submit to Malaky.

Users represent and warrant that:

• the information they provide is accurate;
• they are entitled to provide such information;
• they will update materially outdated information when necessary; and
• they will not submit another person's or entity's information without authorization.

Malaky is not responsible for inaccurate or misleading information submitted by users.

5. Ownership and Intellectual Property Rights

All intellectual property rights and copyrights relating to designs published on Malaky remain with the designer or lawful owner of those rights.

Publishing a design on Malaky does not transfer ownership of the design to Malaky.

By uploading or publishing a design, the user represents and warrants that they:

• are the original owner of the design; or
• own the applicable rights to publish and use it; or
• have obtained all licenses, permissions, and authorizations required to display it on Malaky.

Users are solely responsible for the legality and ownership of content they submit.

If it is determined that a design does not belong to the user or was submitted without appropriate authorization, Malaky may remove the content and suspend, block, or permanently close the relevant page or account.

6. Intellectual Property Infringement Reports

Malaky respects the intellectual property rights of designers, brands, and other rights holders.

If you believe that a design, image, or other content available on Malaky infringes your intellectual property rights, you may submit a report directly from the same page of the design concerned using the reporting option available on that design page.

The person submitting the report may be required to provide information or documentation reasonably necessary to demonstrate ownership or other rights in the disputed content.

Reports must be submitted accurately and in good faith.

While reviewing a report, Malaky may temporarily hide, restrict, or suspend access to the content in question where it considers such action appropriate.

Where infringement is confirmed, Malaky may:

• remove the infringing content;
• issue a warning;
• restrict account functionality;
• temporarily suspend the account; or
• permanently block or terminate the account.

Malaky may request additional information from the relevant parties before making a determination.

7. License Granted to Malaky

Ownership of all original designs remains with their respective owners.

However, by uploading or publishing a design on Malaky, the user grants Malaky a non-exclusive, royalty-free license to display and use the design and related images for purposes associated with the platform.

This may include:

• displaying the design on the Malaky website or application;
• promoting the designer or brand;
• publishing or reposting the design through Malaky's official social media accounts;
• featuring the design in Malaky editorial content;
• using the design in advertising or marketing campaigns for Malaky; and
• including it in promotional materials relating to Malaky.

This license does not transfer ownership of the design to Malaky.

8. Permitted and Prohibited Content

Content published on Malaky must relate to women's fashion and design.

Users may not publish content that:

• relates to men's fashion;
• relates to children's fashion;
• violates generally accepted standards of decency;
• is offensive or inappropriate;
• is unlawful;
• violates the rights of others;
• infringes intellectual property rights;
• contains fraudulent or intentionally misleading information; or
• misuses the Malaky platform.

Malaky may remove any content that it considers inconsistent with these Terms or the purpose of the platform.

9. Phone Numbers, Store Details, and External Contact Information

Designers and brands may not publish their phone number, direct contact details, store details, or information intended to direct Malaky users to communicate outside the platform, unless expressly permitted by Malaky.

This includes, without limitation:

• phone numbers;
• WhatsApp numbers;
• direct store contact information;
• contact information included in a design description;
• contact information incorporated into an image;
• symbols or modified text designed to circumvent platform restrictions; and
• other indirect methods of publishing prohibited contact details.

Malaky may remove such information or content and take appropriate action against the relevant account.

10. Inappropriate Content

Malaky reserves the right to remove any design, image, or content that it considers inconsistent with public morals, appropriate standards of conduct, or the nature of the platform.

Determinations regarding the suitability of content for Malaky remain at the discretion of the platform.

11. Account Suspension and Termination

Where a user violates these Terms and Conditions, Malaky may take any action it considers appropriate, including:

• issuing a warning;
• removing content;
• rejecting a design;
• restricting account functions;
• hiding a designer's page;
• temporarily suspending the account;
• blocking the account; or
• permanently terminating the account.

Where appropriate, such action may be taken without prior notice.

12. Repeat Intellectual Property Infringement

Malaky may permanently suspend or terminate accounts that repeatedly publish content infringing the intellectual property rights of others.

Malaky may also decline to reactivate accounts where violations appear repeated or intentional.

13. User Responsibility

Users remain responsible for:

• their accounts;
• information submitted through their accounts;
• designs and images uploaded to Malaky;
• obtaining all required permissions and rights; and
• their use of the platform.

Malaky is not responsible for disputes between users and third parties concerning ownership, intellectual property rights, or inaccurate information submitted by a user.

14. Platform Availability

Malaky aims to provide a stable service but does not guarantee uninterrupted or error-free availability at all times.

The platform may be temporarily unavailable for maintenance, updates, improvements, or other operational reasons.

15. Changes to Services

Malaky may add, modify, restrict, or discontinue features and services as part of the development of the platform.

Users do not acquire a permanent right to any particular platform feature.

16. Changes to These Terms

Malaky may amend these Terms and Conditions from time to time.

The revised version will be published on the platform together with the date of the latest update.

Continued use of Malaky following publication of updated Terms constitutes acceptance of the revised Terms.

17. Account Deletion

Designers and account holders may request deletion of their Malaky account at any time by contacting us by email and submitting a clear account deletion request.

Malaky may request information reasonably necessary to verify the identity of the account holder before processing the deletion request, in order to protect accounts and prevent unauthorized deletion requests.
